1. Acceptance of Terms

By accessing or using DiplomaPath Homeschool ("DiplomaPath," "we," "us," or "our"), including the web application at app.diplomapathhomeschool.com and the marketing site at diplomapathhomeschool.com, you ("you," "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of DiplomaPath after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

DiplomaPath is a homeschool planning and transcript-generation web application designed for homeschool families across the United States. The service allows you to:

  • Track courses, credits, and grades for high school students
  • Calculate weighted and unweighted GPA (including AP, PSEO, and Honors)
  • Monitor graduation requirements with state-specific credit benchmarks for 28 states
  • Generate and export professional PDF transcripts and diploma certificates
  • Log extracurricular activities, test scores, and attendance records

All student academic data is stored locally in your browser's localStorage and is never transmitted to our servers. DiplomaPath does not provide legal, educational, or counseling advice.

3. Eligibility

DiplomaPath is designed for use by parents and legal guardians managing a homeschool program. To use this service, you must:

  • Be at least 18 years of age
  • Be a parent or legal guardian responsible for the homeschool student(s) whose records you are managing
  • Have legal authority to enter and manage the student's educational records
  • Agree to these Terms on behalf of yourself and any household members who use the service under your account

This service is not intended for direct use by students. By using DiplomaPath, you represent and warrant that you meet all eligibility requirements. If you do not, you must not use the service.

4. License and Permitted Use

Subject to your compliance with these Terms and payment of applicable fees, DiplomaPath grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, non-commercial homeschool recordkeeping purposes.

You may not:

  • Share, resell, sublicense, or distribute access to DiplomaPath to others
  • Use the service on behalf of a school, institution, or commercial tutoring business without a separate written agreement
  • Reverse engineer, copy, decompile, or create derivative works of the application
  • Use automated tools to scrape, crawl, or extract data from the service
  • Attempt to circumvent license key validation or other access controls
  • Use the service to create fraudulent, misleading, or falsified academic records
  • Introduce malicious code, viruses, or harmful data into the service

5. Free Demo

DiplomaPath offers a free demo with seeded sample data so you can explore the application without a paid plan. No credit card is required. The demo includes watermarked PDF exports and does not allow entry of real student data. Paid features, including unwatered PDF export and real student data entry, require a paid subscription.

6. Subscriptions and Billing

Paid plans are offered on a monthly or annual basis. All payments are processed by Lemon Squeezy, who serves as the merchant of record and is responsible for collecting and remitting applicable sales taxes. By completing a purchase you also agree to Lemon Squeezy's Terms of Service.

  • Annual plans are billed once per year and renew automatically unless canceled before the renewal date. You will receive a renewal reminder at least 7 days before each annual charge.
  • Monthly plans are billed once per month and renew automatically unless canceled.
  • Prices are listed in USD and subject to applicable taxes determined by your location.
Auto-Renewal Disclosure (Minn. Stat. § 325G.03 · Cal. Bus. & Prof. Code § 17601 et seq.) Subscription plans automatically renew at the end of each billing period at the then-current rate. You will receive a reminder email at least 7 days before each annual renewal charge. You may cancel at any time through your Lemon Squeezy account portal or by emailing support@diplomapathhomeschool.com. Cancellation stops future billing; access continues through the end of the current paid period. No partial-period refunds are issued on cancellation except under the 7-day satisfaction guarantee in Section 7.

7. Refund Policy

7-Day Satisfaction Guarantee If DiplomaPath isn't right for you, email us within 7 days of your initial purchase at support@diplomapathhomeschool.com and we will issue a full refund, no questions asked.

Export carve-out: Refunds are not available if a PDF transcript or course descriptions export has been downloaded during the subscription period. Because PDF exports are digital goods delivered immediately upon generation, they are non-refundable once created, regardless of the 7-day window.

After 7 days, all sales are final. Refunds are not available for subscription renewals. No partial refunds are issued for unused time within a billing period, except under the 7-day guarantee.

8. Your Data

You own all data you enter into DiplomaPath. All academic records, student names, courses, grades, test scores, activities, are stored exclusively in your browser's localStorage and are never transmitted to, stored on, or accessible by our servers.

  • We have no ability to access, recover, or delete your student data on your behalf
  • You are responsible for exporting and maintaining backups of your records using the in-app export feature
  • Clearing your browser data, switching browsers, or switching devices will permanently delete locally stored records
  • Canceling your subscription does not delete local data; you retain read-only access after expiration
  • We provide a 30-day access grace period following subscription lapse during which PDF export remains available (this grace period is separate from, and does not extend, the 7-day refund guarantee in Section 7)

9. FERPA Alignment and Student Data

The Family Educational Rights and Privacy Act (FERPA) applies to educational agencies and institutions that receive federal funding. DiplomaPath is not a federally funded educational institution and is not directly governed by FERPA. However, we design our practices to align with FERPA principles:

  • Parental control: Parents and guardians retain full access to, control over, and the right to delete all educational records entered into DiplomaPath at any time.
  • No unauthorized disclosure: We do not share, sell, or disclose student educational records to any third party without your explicit consent.
  • Data minimization: We collect only information necessary to provide the service's educational planning and transcript functions.
  • Accuracy: You have the right to review and correct any information stored in the application at any time through settings and course management interfaces.

Transcripts generated by DiplomaPath are parent-issued homeschool records, not records of a federally funded institution. Recipients of DiplomaPath transcripts should be informed that the transcript is issued by the parent or guardian acting as the homeschool administrator.

Parent as Data Controller. The parent or legal guardian who creates a DiplomaPath account is the sole data controller for all student academic records entered into the application. DiplomaPath acts solely as a software tool, we do not access, process, sell, or share student academic records. Student names, courses, grades, test scores, activities, and all other academic data are stored exclusively on the parent’s own device and are never transmitted to our servers. This architecture means that state student data privacy laws, including California SOPIPA, New York Education Law 2-d, Texas TSSPA, and similar statutes, are not triggered by DiplomaPath’s operation, as those laws govern educational institutions and their vendors, not parent-controlled software tools. Nonetheless, we align with those laws’ purposes: we do not use student data for advertising, profiling, or any purpose beyond providing the service you purchased.

10. Educational Disclaimer

DiplomaPath is a planning and record-keeping tool, not a licensed educational institution, accreditation body, or source of professional educational advice.

  • Transcripts generated by DiplomaPath are formatted documents based on data you provide. They are not official transcripts from an accredited institution. Acceptance by any college, university, employer, or other institution is at that institution's sole discretion.
  • Graduation requirements and credit benchmarks displayed in the app are provided for informational guidance only. State-specific benchmarks are based on public school college-prep diploma pathways and applicable statutes as of the date shown in the app. Requirements may change. Always verify current requirements with your state’s Department of Education or official homeschool regulatory body.
  • GPA calculations follow standard weighted and unweighted formulas but may differ from those used by specific colleges or institutions.
  • DiplomaPath makes no representation or warranty that transcripts or diplomas generated using the service will be accepted by any specific institution.
  • You are responsible for verifying that your homeschool program meets all applicable state requirements, including annual assessment, instruction mandates, notification obligations, and portfolio requirements specific to your state.
  • DiplomaPath does not provide legal, educational, or professional advice. Consult your local school district, your state’s Department of Education, or a qualified educational consultant for official guidance.

11. Children's Privacy (COPPA)

DiplomaPath is directed at parents and legal guardians, not at children. We do not knowingly collect personal information directly from children under 13. All data entered into DiplomaPath is entered by and under the control of a parent or legal guardian.

  • Student data is stored exclusively on the parent's device and is never transmitted to our servers
  • We do not share, sell, or disclose student information to third parties for advertising or any other purpose
  • Because all data is stored locally, we cannot access or delete student records on your behalf, deletion occurs when browser data is cleared by the parent
  • If you believe a child under 13 has used the service without parental supervision, contact us immediately at support@diplomapathhomeschool.com

12. Intellectual Property

DiplomaPath and all associated software, design, text, graphics, logos, and content are owned by or licensed to DiplomaPath Homeschool and protected by copyright, trademark, and other applicable intellectual property laws. All rights are reserved.

Transcripts, diplomas, and other documents you generate using the service, based on data you enter, are your own works. DiplomaPath claims no ownership over content you create.

The DiplomaPath name, logo, and associated marks may not be used in any manner without prior written permission.

13. Third-Party Services

DiplomaPath relies on the following third-party services to operate:

  • Lemon Squeezy, payment processing and subscription management (merchant of record)
  • Cloudflare, web hosting and content delivery network
  • Google Analytics, anonymous usage analytics (IP addresses are anonymized; no student data is shared)

These services operate under their own terms of service and privacy policies. DiplomaPath is not responsible for the availability, performance, security practices, or data handling of third-party services. A disruption, outage, or security incident at a third-party provider does not entitle you to a refund beyond what is provided by the 7-day satisfaction guarantee in Section 7.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES. WE DO NOT GUARANTEE THE ACCURACY OF MINNESOTA REQUIREMENT DATA, GPA CALCULATIONS, OR THAT ANY TRANSCRIPT GENERATED WILL BE ACCEPTED BY ANY SPECIFIC INSTITUTION.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIPLOMAPATH'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO DIPLOMAPATH IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50 USD).

DIPLOMAPATH IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or inability to access locally stored records
  • Inaccuracies in GPA calculations, credit tracking, or requirement displays
  • Rejection of transcripts by any educational institution or employer
  • Failure to meet Minnesota homeschool reporting or assessment requirements
  • Any decision made in reliance on information provided by the service
  • Third-party service outages, breaches, or failures

16. Indemnification

You agree to indemnify, defend, and hold harmless DiplomaPath Homeschool and its owners, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of or access to the service in violation of these Terms
  • Your violation of any third-party right, including intellectual property, privacy, or educational records rights
  • Any fraudulent, false, or misleading information you enter into or generate through the service
  • Any claim by a third party arising from a transcript or diploma you generated using DiplomaPath

17. Force Majeure

DiplomaPath shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or public health emergency, war, terrorism, internet or telecommunications outages, cyberattacks on infrastructure providers, governmental actions or regulations, or failure of third-party hosting or payment services. In such events, we will make reasonable efforts to restore service and communicate updates to affected users.

18. Service Modification and Discontinuation

We reserve the right to modify, suspend, or discontinue any feature or aspect of the service at any time. For significant feature changes, we will provide at least 30 days' notice via in-app notification or email to active subscribers.

In the event of full service discontinuation:

  • We will provide at least 60 days' advance notice to all active subscribers
  • PDF export will remain fully functional throughout the notice period
  • Because all student data is stored locally in your browser, service discontinuation does not delete your records, your data remains until you clear it
  • We strongly recommend exporting all records before any announced discontinuation date

19. Dispute Resolution and Arbitration

Please read this section carefully, it affects your legal rights. It requires individual arbitration of disputes and waives your right to participate in a class action lawsuit.

Step 1. Informal Resolution: Before initiating formal proceedings, you agree to contact us at support@diplomapathhomeschool.com and give us 60 days to attempt to resolve the dispute informally. Most issues can be resolved at this stage.

Step 2. Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the service, including questions about the validity, enforceability, or scope of this arbitration agreement, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as stated below.

  • Arbitration will be conducted in Hennepin County, Minnesota, or by videoconference if both parties agree
  • The arbitrator may award the same damages and relief that a court could award on an individual basis
  • Either party may seek emergency injunctive relief from a court of competent jurisdiction to preserve the status quo pending arbitration
  • The AAA Consumer Arbitration Rules are available at adr.org

Small Claims Exception: Either party may bring an individual claim in small claims court in Hennepin County, Minnesota, provided the claim qualifies under that court's jurisdictional limits and remains an individual (non-class) claim.

Class Action Waiver YOU AND DIPLOMAPATH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY. NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this waiver is found unenforceable in a particular case, the arbitration agreement shall not apply to that case, and the parties agree to resolve it in state or federal court in Hennepin County, Minnesota.

Opt-Out Right: You may opt out of this arbitration agreement within 30 days of first using the service by emailing legal@diplomapathhomeschool.com with your name and a clear statement of your intent to opt out. Opting out does not affect your right to use DiplomaPath.

20. Governing Law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles. For disputes not subject to arbitration under Section 19, you consent to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed entirely if modification is not possible. The remaining provisions shall remain in full force and effect. The invalidity of one provision does not affect the validity of the remaining Terms.

22. Digital Millennium Copyright Act (DMCA)

DiplomaPath respects intellectual property rights. If you believe that material you own the copyright to has been used in a way that constitutes infringement, please send a written DMCA notice to our designated agent:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location within the service; (3) your contact information; (4) a statement of good faith belief that the use is not authorized; and (5) your physical or electronic signature. We will respond to valid DMCA notices in accordance with applicable law and maintain a repeat-infringer termination policy.

23. Changes to These Terms

We reserve the right to modify these Terms at any time. Revised Terms will be posted on this page with an updated effective date. For material changes, we will notify active subscribers by email at least 14 days before changes take effect. Continued use of DiplomaPath after the effective date constitutes acceptance of the revised Terms.
